Hiscox IR35 Insurance: What Hiscox Does and Does Not Cover

Hiscox is one of the best known names in UK contractor insurance, so it is a reasonable place to start looking for IR35 cover. It is not a place you will find it. The short answer: Hiscox does not sell IR35 insurance. Its contractor range is professional indemnity, public liability and portable equipment insurance. It publishes guides explaining IR35 to contractors, which is probably why people search for the two together, but it does not offer a policy that defends an IR35 enquiry or pays a tax liability arising from one.

This article sets out what Hiscox does sell, what its legal protection add-on covers, and where the genuine grey area sits.

What Hiscox sells to contractors

The Hiscox contractor insurance page lists three products: professional indemnity insurance, public liability insurance, and portable equipment insurance. Employers' liability is referenced where a contractor has staff.

IR35 appears on that page four times, and every appearance is editorial rather than a product. The page carries a heading about IR35 and its implications for contractors, a line explaining that IR35 refers to two types of tax legislation, and a link to a Hiscox blog article titled "What is IR35 and what does it mean for contractors?". The words "tax investigation", "HMRC" and "tax liability" do not appear on the page at all.

So Hiscox treats IR35 as a topic to explain, not a risk to underwrite.

The legal protection add-on, and why it is not IR35 cover

Hiscox does sell something tax-adjacent. Its legal protection insurance includes, in Hiscox's own wording:

"Negotiations on your behalf, and representation for appeal proceedings, involving Income or Corporation Tax compliance checks"

and

"Proceedings after a tax compliance check."

That sounds close to what a contractor wants. Three things separate it from a dedicated IR35 policy.

It cannot be bought on its own. Hiscox states plainly: "You can't buy Hiscox legal protection insurance on its own. Instead, you would buy it alongside any other cover type as part of a business insurance policy." A contractor who wants tax enquiry representation from Hiscox has to buy other Hiscox cover to get access to it.

It covers costs, not the tax. The wording describes negotiation and representation. It does not describe paying the tax, interest and penalties if HMRC wins the argument. That distinction is the single most important one in IR35 insurance, and it is the difference between an enquiry defence policy and a tax liability policy. It never mentions IR35. Searching the legal protection page for "IR35" returns nothing. A product that intends to cover the best known tax status risk in UK contracting would normally say so.

There is also an exclusion worth knowing about: "Claims arising from tax avoidance schemes" are excluded.

The part nobody should pretend to be certain about

An IR35 enquiry is, mechanically, a compliance check into income tax and National Insurance. Hiscox's legal protection cover refers to Income Tax compliance checks. So it is entirely possible that the cover would respond to representation costs in an IR35 enquiry.

Hiscox does not say either way, and this article is not going to guess on its behalf. Hiscox itself points readers to the policy documents for the full details of inclusions and exclusions, and that is where the answer actually lives.

If you already hold Hiscox business insurance with legal protection attached, the useful action is to ask Hiscox directly whether an IR35 status enquiry falls within the tax compliance check wording, and to get the answer in writing before you rely on it. Do not assume either way based on this page or any other comparison site.

What can be said without qualification is narrower and still useful: Hiscox does not market, price or sell a product as IR35 cover, and nothing it publishes tells a contractor they are protected against an IR35 outcome.

Who does sell IR35 insurance

Markel Tax sells Survive35 TaxSafe through accountants and specialist brokers, and requires a contract review before cover is issued.

Roots Contractor Insurance is a smaller, FCA authorised option selling online.

Before buying any of them, it is worth understanding what an HMRC IR35 investigation actually costs, because that is the number the premium is being weighed against. If you have already established an outside position, whether you still need cover is a separate question with a less obvious answer than most people expect.
